1. Acceptance of Terms
By downloading, installing, or using the SureRyde mobile application ("App"), operated by Forward Alpha, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
SureRyde is a carpooling platform that connects drivers offering rides with riders seeking transportation. We facilitate connections between users but do not provide transportation services directly.
Important: SureRyde is a technology platform, not a transportation company. We do not employ drivers or own vehicles.
3. Eligibility
To use the App, you must:
- Be at least 18 years old
- Have a valid driver's license (if offering rides)
- Have valid vehicle insurance and registration (if offering rides)
- Be legally permitted to enter into binding contracts
- Not be prohibited from using our services under applicable law
4. Account Registration
4.1 Account Creation
You must create an account to use the App. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information
- Keep your login credentials secure
- Notify us immediately of unauthorized access
4.2 Verification
We may require identity verification, including:
- Phone number verification
- Government ID verification (optional but recommended)
- Background checks for drivers (where applicable)
4.3 Account Deletion
You may delete your account at any time through the App settings (Profile → Settings → Delete Account) or by contacting admin@theforwardalpha.com. Upon deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
5. User Conduct
5.1 General Conduct
You agree NOT to:
- Provide false or misleading information
- Use the App for illegal purposes
- Harass, threaten, or harm other users
- Discriminate against users based on protected characteristics
- Use the App while impaired by drugs or alcohol
- Violate traffic laws or regulations
5.2 Driver Responsibilities
If you offer rides, you agree to:
- Maintain a valid driver's license
- Maintain proper vehicle insurance
- Keep your vehicle in safe operating condition
- Follow all traffic laws
- Arrive at agreed pickup times
- Not exceed passenger capacity limits
- Not charge more than the agreed price
5.3 Rider Responsibilities
If you book rides, you agree to:
- Be at the pickup location on time
- Treat drivers and their vehicles with respect
- Pay the agreed fare
- Follow driver's reasonable vehicle rules
- Not bring prohibited items (weapons, illegal substances)
- Wear seatbelts as required by law
6. Payments and Fees
6.1 Ride Pricing
- Drivers set their own prices per seat
- Prices are displayed before booking confirmation
- SureRyde may charge a service fee
6.2 Ride Cancellation Policy
- Cancellations made 24+ hours before departure: Full refund
- Cancellations made 2-24 hours before: 50% refund
- Cancellations made less than 2 hours before: No refund
- Driver cancellations: Full refund to riders
7. Subscriptions and In-App Purchases
7.1 SureRyde Pro Subscription
The App offers an auto-renewable subscription plan:
- SureRyde Pro: $7.99 per month
- Includes unlimited matches, 3 monthly ride boosts, and priority features
- A 7-day free trial may be offered to new subscribers
7.2 Subscription Billing
- Payment is charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current billing period
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the current subscription price
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
7.3 Managing Subscriptions
- You can manage or cancel your subscription at any time through your device's App Store or Google Play Store settings
- iOS: Settings → Apple ID → Subscriptions
- Android: Google Play Store → Subscriptions
- Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that date.
7.4 Credit Packages
The App offers consumable in-app credit packages:
- 5 Credits — $1.99
- 15 Credits — $4.99
- 30 Credits — $8.99
Credits are used to boost ride visibility. Credits are non-refundable, non-transferable, and have no cash value. Credits do not expire.
7.5 Refunds for In-App Purchases
All in-app purchases (subscriptions and credit packages) are processed through the Apple App Store or Google Play Store. Refund requests for in-app purchases must be directed to Apple or Google through their respective refund policies:
8. Ratings and Reviews
- Users may rate and review each other after completed rides
- Ratings must be honest and based on actual experience
- We reserve the right to remove fraudulent or inappropriate reviews
- Users with consistently low ratings may be suspended
9. Safety
9.1 Verification Features
We offer verification features including:
- Phone verification
- ID verification
- Profile photos
9.2 Safety Guidelines
- Share ride details with trusted contacts
- Use in-app messaging for communication
- Meet in public, well-lit areas
- Trust your instincts — cancel if uncomfortable
9.3 Reporting
Report safety concerns, incidents, or policy violations through the App or by contacting admin@theforwardalpha.com.
10. Intellectual Property
All content, features, and functionality of the App are owned by Forward Alpha, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.
11. Disclaimers
11.1 Service Availability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
11.2 User Interactions
WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF USERS. YOU USE THE SERVICE AND INTERACT WITH OTHER USERS AT YOUR OWN RISK.
11.3 Transportation
WE DO NOT PROVIDE TRANSPORTATION SERVICES. WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF RIDES OFFERED THROUGH THE APP.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORWARD ALPHA, LLC SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or goodwill
- Personal injury or property damage resulting from rides
- Actions or omissions of third parties
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS.
13. Indemnification
You agree to indemnify and hold harmless Forward Alpha, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your interactions with other users
14. Termination
14.1 By You
You may terminate your account at any time through the App settings or by contacting admin@theforwardalpha.com.
14.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Fraudulent or illegal activity
- Safety concerns
- Extended inactivity
- Any other reason at our discretion
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, you agree to contact us at admin@theforwardalpha.com to attempt informal resolution.
15.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration, except for claims that qualify for small claims court.
15.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions.
16. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
17. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or email. Continued use after changes constitutes acceptance.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward Alpha, LLC.
